Terms of service
Last updated 23 October 2026
The agreement
These terms are between you and Alec Nicholson, trading as Kudu Digital, a sole trader, of 40 Dingle Road, Up Holland, WN8 0EW ("we", "us"). By creating an account or using SiteScope you accept them, together with our privacy policy and, where you put other people's personal data into SiteScope, our data processing terms.
If you are accepting on behalf of a business, you confirm you are entitled to bind it, and "you" means that business.
What we provide
SiteScope as described on this site and in the documentation: running a job from the first enquiry to the end of the defects period — quoting, the contract and its payment schedule, the programme and tasks, a site diary and photographs, snagging, documents and building-control records, site safety, subcontractors and CIS, invoicing, a client view, and notifications in the app and by email — with what each plan includes set out on the pricing page, and, on the plans that include it, the FlowAI assistant.
We may change or add features. Where we remove something you depend on, we will give reasonable notice.
We aim for SiteScope to be available whenever you need it but we do not offer a contractual uptime guarantee at this stage, and we would rather say so than promise one we have not built the operational cover for.
Accounts and access
You are responsible for what happens under your account, for keeping your password to yourself, and for who you invite and at what role.
One account per person. Shared logins defeat the audit trail, which is the point of much of the product.
You must tell us promptly if you believe an account has been compromised.
Your data stays yours
Everything you put into SiteScope remains yours. We claim no ownership of your projects, documents, photographs or records.
You grant us the licence needed to run the service — to store, process, transmit and display that content to the people you have given access to, and to back it up.
Where that content includes personal data about other people — your clients, your team, your subcontractors, people who enquire — you are responsible for having a lawful basis to hold it and for telling them how it is used. We process it for you under the data processing terms, which form part of this agreement.
We do not use your content to train AI models and we do not sell it. Where an AI feature is used, only what is needed to answer that request is sent to the model provider.
You can export at any time: documents and photographs download as the files you uploaded, and the handover pack gathers a project into a single PDF. Ask us if you need a fuller export.
What you must not do
- Upload anything unlawful, or anything you do not have the right to upload
- Use SiteScope to store special-category personal data it is not designed for — medical records, for instance. Health and safety records may need to say what injury happened; keep them to what the incident and the law require
- Attempt to access another company's or another project's data
- Probe, scan or load-test the service without asking us first — ask, and we will usually say yes
- Resell or white-label the service other than under a Bespoke arrangement
We may suspend an account that is doing any of the above, and will tell you why.
Plans, limits and payment
Plan limits are enforced in the database. Being at a limit stops you adding more. Dropping to a smaller plan never deletes anything, but what is over its limits is locked or removed, as below.
Paid plans are billed in advance by card, through Stripe, either monthly or yearly. We are not VAT registered, so no VAT is charged.
A plan renews at the end of each period until it is cancelled. Cancelling, from the plan screen of the website, takes effect at the end of the period already paid for: the plan carries on until then, and the account then moves to Free. What has been paid for a period that has started isn't refunded.
Moving to a smaller plan — by changing plan, by cancelling, or because a payment was not made — means keeping within its limits. An owner or admin chooses which projects stay open and who keeps access. Projects not kept are locked: everything in them is kept, but nobody at your company can open or change them until there is room on your plan again. People not kept lose access to your company and its projects. Clients who lose access to a project are told by email and can download a copy of what they could see on it for 30 days. If the plan drops before a choice is made, your company's projects are paused until an owner or admin makes it.
Moving to a dearer plan, or between monthly and yearly, is charged straight away for the difference and takes effect once that payment succeeds. Moving to a cheaper plan takes effect straight away, and the unused part of what you have paid is credited against your next invoice.
If a payment fails it is retried for about two weeks, and the plan carries on meanwhile. If it still has not been paid, the account moves to Free.
We may change our prices. We will email account owners at least 30 days before a new price applies to them; it applies from the first renewal after that, and you can cancel before then.
FlowAI comes with a monthly allowance on the plans that include it. When the allowance is used, FlowAI pauses until the next month; it is never charged separately.
FlowAI
The assistant answers from your project data and can be wrong. Every reply says so. It is a way to avoid looking something up, not a source of truth — check anything you would act on.
It never makes a change without you confirming it, and it runs on your own permissions rather than elevated ones.
It does not give structural, legal or building-regulations advice, and you must not treat it as though it does. Those remain matters for you and the relevant professional.
Professional responsibility
SiteScope records and organises the work; it does not do it. You remain responsible for the construction work itself, for compliance with the Building Regulations and every other legal obligation you are under — including CIS returns and VAT — for the accuracy of what you record, and for the advice you give your clients.
Nothing in SiteScope — a template, a generated inspection schedule, a handover pack, a CIS calculation or a FlowAI answer — is a substitute for your own professional judgement.
The apps
SiteScope's iPhone and Android apps open the same service, are free, and are covered by these terms. Nothing is sold inside them: plans are chosen and paid for on the website.
If you got the iPhone app from the App Store, Apple's standard licence agreement for apps also applies to it. Apple and Google are not parties to these terms and are not responsible for SiteScope or its support; that is us.
Liability
Nothing here limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be limited.
Subject to that, we are not liable for indirect or consequential loss, loss of profit, loss of business, or loss of data where you have not kept your own copies of what matters.
Our total liability in any twelve-month period is limited to the amount you paid us in that period, or £100 where you are on the free plan.
We are not responsible for delays or failures caused by events beyond our reasonable control, such as a failure at one of our suppliers or a wide internet outage. We will tell you, and keep the effect as small as we can.
This is a business tool sold to businesses. If you are a consumer using it because a builder invited you, your statutory rights are unaffected.
Ending it
You can stop using SiteScope at any time, and delete your account yourself from your profile. If you are the only owner of a company, deleting your account deletes the company and everything in it, straight away and for everyone on its projects. Anything you added to another builder's project stays on their record, without your name.
We may end this agreement on 30 days' notice, or immediately for a serious breach. If we end it other than for a breach, we will give you a reasonable period, and reasonable help, to get your data out, and refund any part of a period you have paid for and won't get.
Clients invited onto a project keep access to that project while the builder's account is live.
Changes
We may update these terms. Where a change materially affects you, we will tell account owners by email or in the app before it takes effect. Continuing to use SiteScope after that is acceptance.
General
These terms, the privacy policy and the data processing terms are the whole agreement between us about SiteScope. If part of them can't be enforced, the rest still applies. If we don't enforce something straight away, we can still do so later.
We may transfer this agreement to a business that takes over SiteScope — a company set up to run it, for instance — and will tell you if we do. You may not transfer it without our agreement. Nobody else has rights under these terms.
Law
These terms are governed by the law of England and Wales, and its courts have jurisdiction. If you are a consumer living in Scotland or Northern Ireland, you can also bring proceedings in your local courts.
